1. Who We Are

Upchatty is a business communication platform. "We," "us," and "our" refer to Upchatty and its operators. "You" refers to the user of this platform.

2. Information We Collect

Account information: Name, email address, and password (stored as a secure hash) when you register.
Profile data: Display name, avatar, and role within your workspace.
Messages and files: Content you send is encrypted at rest using AES-256-GCM. Messages are associated with your account and stored in our database.
Usage data: Activity timestamps, read receipts, and presence indicators to support platform functionality.
Device and browser data: Browser type and IP address may be logged for security and abuse prevention.

3. How We Use Your Information

To provide and operate the Upchatty platform.
To allow your workspace administrators to manage team communications.
To send transactional notifications (e.g., email verification, password reset).
To improve platform performance and fix bugs.

4. Workspace Administrator Access

Upchatty is a managed workplace tool. Your workspace Director and Admin-role members can view messages, files, and member activity within the workspace. By using Upchatty under an organization's workspace, you acknowledge this access.

5. Data Sharing

We do not sell your personal data. We may share data with:

Supabase: Our database and authentication infrastructure provider.
Anthropic: AI-generated summaries and replies are processed by Anthropic's API. Message content sent to the AI feature is subject to Anthropic's privacy policy.
Legal authorities: When required by law or to protect the rights of users.

6. Data Retention

Your data is retained for as long as your account is active. When you delete your account, your profile is anonymized and your authentication credentials are permanently removed within 30 days.

7. Your Rights

Access the personal data we hold about you.
Request correction of inaccurate data.
Request deletion of your account and associated data.
Export your data via the admin export tool (Directors only) or by contacting support.

8. Security

Messages are encrypted at rest using AES-256-GCM. All data is transmitted over HTTPS/TLS. Authentication is managed by Supabase with industry-standard JWT tokens.

9. Children's Privacy

Upchatty is intended for users 18 years of age or older. We do not knowingly collect data from minors.

1. Acceptance

By creating an account or using Upchatty, you agree to these Terms of Service. If you do not agree, do not use the platform.

2. Eligibility

You must be at least 18 years old and authorized to enter into a binding agreement to use Upchatty. The platform is intended for business and professional use only.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your password.
You are responsible for all activity that occurs under your account.
You must notify us immediately of any unauthorized access to your account.
You may not share your login credentials with others.

4. Acceptable Use

You agree not to use Upchatty to:

Transmit unlawful, harassing, defamatory, or abusive content.
Share malware, viruses, or any malicious code.
Attempt to gain unauthorized access to other users' accounts or the platform infrastructure.
Violate any applicable local, national, or international law.
Impersonate any person or entity.

5. Workspace Policies

Workspace Directors may set additional usage policies for their organization. Members of a workspace are subject to both these Terms and their organization's policies. Directors and Admins may moderate content, remove members, and access communications within their workspace.

6. Content Ownership

You retain ownership of content you create. By posting content to Upchatty, you grant us a limited license to store, transmit, and display that content solely for the purpose of operating the platform.

7. AI Features

Upchatty includes AI-powered features (Orbit AI) that process workspace message content to generate summaries, search results, and reports. By using AI features, you consent to message content being processed by our AI provider (Anthropic). Do not submit sensitive personal data to AI features.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We reserve the right to modify, suspend, or discontinue the platform at any time with reasonable notice.

9. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may delete your account at any time via Settings → Danger Zone.

10. Limitation of Liability

To the maximum extent permitted by law, Upchatty is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the platform.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the platform after changes constitutes acceptance of the revised Terms.
